Este artigo se divide em quatro partes. Inicialmente apresentamos a noção de biopolítica de modo introdutório, considerando a relação entre poder soberano e biopoder. Voltamo-nos para a elaboração foucaultiana do termo de modo a esclarecer, em linhas gerais, seu sentido. Essa breve análise da noção de biopolítica encaminha-nos para o conceito de tanatopolítica, que aparece, na segunda parte do texto, como epíteto da derivação funesta da biopolítica. Na terceira parte, a partir de uma perspectiva biopolítica, lançamos luz sobre a crise (...) que enfrentamos. Trata-se de um esforço de evidenciar o sentido biopolítico da crise atual, considerando o conteúdo das reflexões de Foucault. Finalmente, na quarta parte, atualizamos o debate acerca da biopolítica por meio de uma análise da noção de imunidade formulada por Esposito, a qual fornece uma importante chave interpretativa da pandemia atual. An investigation into the concept of life in Michel Foucault's work leads both to a more precise understanding of the development of his work and to the elaboration of a critical look at recent interpretations of his thought, especially in relation to the readings of the concept of biopolitics that oscillate between a positive and a negative interpretation of this concept. The analyzes of this term, which have proliferated among recent readings of Foucault's work, seem to lack a more accurate (...) understanding of the problem of life, from which largely results the very acuity of Foucault's reflections on biopower. What above all guides this brief and incipient reflection on Foucault’s notion of life is Muhle's (2021) finding that Foucault does not attribute an ontological status to the notion of life and that this life plays a double role (Gegenstand and Funktionsmodell) regarding its implication in biopower, as well as Mauer's assumption (2015) that Foucault turns to the notion of life in order to deviate from the concept of man, i.e., from humanism. These two hypotheses help us not only to shed light on the elaboration of Foucault's thought as a whole, particularly with regard to biopower, but also on recent readings of the notion of biopolitics. Questions of responsibility arise at all levels of health care. Most prominent has been the issue of patient responsibility. Some health conditions that risk death or serious harm are partly the result of lifestyle behaviours such as smoking, lack of exercise, or extreme sports. Are patients (...) with such conditions responsible for them? If so, might healthcare providers, be they state-run systems or private entities, be justified in treating such patients differently? This paper studies a class of models proposed by Adham and Walker, featuring a Gompertz type distribution where the dependence structure is modeled by a lognormal distribution, and develops a new multivariate formulation that facilitates several numerical and computational aspects. This paper also implements the FBST, the Full Bayesian Significance Test for pertinent sharp (precise) hypotheses on the lognormal covariance structure. Free software introduces a challenge to the classical conception of individual rights. The model of software licensing given by the General Public License generates the question whether it constitutes an exercise or a wavering of copyright. It is argued in this paper that the later alternative is entrenched in the classical concept of freedom as autonomy, which, by its turn, is reflected in a classical conception of individual rights based on the model of propriety as a dominion over an exclusive (...) object (res). We provide grounds for a concept of non-exclusive individual rights, based on the notion of freedom as reciprocity, in order to obtain more solid legal foundations for the free licensing of software. The concept of freedom as reciprocity and the corresponding reconstruction of non-exclusive subjective rights achieved in this paper is an exercise in general theory of law and thus may be applied to other legal fields where the classical notion of freedom and the property of exclusivity do not fit properly. The processing of sensitive information in the health field is subject to rigorous standards that guarantee the protection of information confidentiality. Recently, the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) stated their formal opinion on a standard procedure in dental offices involving the submission of a questionnaire that includes the patient's health status. HIV infection status is included on the form. The Authority has stated that all health data collection must be in accordance with the current (...) Italian normative framework for personal data protection and respect the patient's freedom. This freedom allows the patient to decide, in a conscious and responsible way, whether to share health information with health personnel without experiencing any prejudice in the provision of healthcare requested. Moreover, data collection must be relevant and cannot exceed the principles of treatment goals with reference to the specific care of the concerned person. However, the need for recording information regarding HIV infection at the first appointment, regardless of the clinical intervention or therapeutic plan that needs to be conducted, should not alter the standard protection measures of the healthcare staff. O artigo apresenta apontamentos sobre “marketing de guerra santa ” , o planejamento estratégico de gerenciamento de mercado religioso aplicado por algumas das igrejas cristãs da contemporaneidade. Vale-se de reflexões a partir de observação participante e de consulta a bibliografia especializada. Apontam-se algumas das formas com as quais essas igrejas se midiatizam e se inserem num contexto de espetacularização e mercadorização próprios da sociedade do tempo presente e imediato. O mercado religioso no qual se inserem as agências que praticam este (...) tipo de marketing passa por contextos de adequação ao capital simbólico e ao arcabouço cultural dos fiéis, sendo possível identificar o investimento ideológico e econômico na fabricação e veiculação de suas estratégias, discursos e mercadorias. O objetivo é o de perceber algumas das maneiras com as quais firmas religiosas (tomando como maior exemplo as igrejas neopentecostais) veiculam as mercadorias que produzem ou se apropriam, e os discursos que reverberam, relacionando-os a uma cultura de massa e a uma sociedade espetacular; fomentando a discussão sobre como tais igrejas e outros segmentos religiosos aplicam o marketing de guerra santa para melhor posicionarem sua marca no mercado e conquistarem mais fiéis. Espetáculo da fé.This article presents some notes on Jesus´ marketing, strategic planning of management of religious market applied by some of contemporary Christian churches. For this purpose, the reflections from participant observation and literature on the subject are validated. Some of the ways these churches mediate themselves and are part of a context of spectacle and commoditization are also pointed out. The religious market has adequate to the symbolic capital and to the cultural framework of the participants of the churches. Because of that it is possible to identify the ideological and economic investment in the manufacturing and delivery of their strategies, discourses and products. This article aims to highlight some of the ways in which neo-Pentecostal churches convey the goods they produce and the speeches that reflect them, relating them to a mass culture and a society of the spectacle. Tal objetivo justifica-se na importância de analisarmos o espaço de prestígio que ainda é reservado para a racionalidade científica, a qual é propagada sem a devida contextualização histórico-filosófica. Tomaremos como base a poesia Eu-mulher de (...) Conceição Evaristo, partindo do pressuposto de que um ensino eurocentrado exclui de seu bojo os grupos minorizados, principalmente a mulher negra. O presente artigo procura avaliar a política de terror como estratégia de controle social a partir da constituição de uma natureza feminina e de propostas para sua remodelagem. Para tanto, foram analisadas mensagens eletrônicas (hoaxes) que circulam na internet. Tais mensagens acabam por propor a segregação social de grupos minoritários. A temática base de tal remodelagem é garantida pela difusão do terror, que serve a estratégias de controle social.

The Adverse Outcome Pathway (AOP) concept is a knowledge assembly and communication tool to facilitate the transparent translation of mechanistic information into outcomes meaningful to the regulatory assessment of chemicals. The AOP framework and associated knowledgebases (KBs) have received significant attention and use in the regulatory toxicology community. However, it is increasingly apparent that the potential stakeholder community for the AOP concept and AOP KBs is broader than scientists and regulators directly involved in chemical safety assessment. In this paper we (...) identify and describe those stakeholders who currently—or in the future—could benefit from the application of the AOP framework and knowledge to specific problems. We also summarize the challenges faced in implementing pathway-based approaches such as the AOP framework in biological sciences, and provide a series of recommendations to meet critical needs to ensure further progression of the framework as a useful, sustainable and dependable tool supporting assessments of both human health and the environment. Although the AOP concept has the potential to significantly impact the organization and interpretation of biological information in a variety of disciplines/applications, this promise can only be fully realized through the active engagement of, and input from multiple stakeholders, requiring multi-pronged substantive long-term planning and strategies. Neuropsychological dissociations between regular and irregular English past-tense morphology have been reported using a lexical decision task in which past-tense primes immediately precede present-tense targets. We present N400 event-related potential data from healthy participants using the same design. Both regular and irregular past-tense forms primed corresponding present-tense forms, but with a longer duration for irregular verbs. Phonological control conditions suggested that differences in formal overlap between prime and target contribute to, but do not account for, this difference, suggesting a link (...) between irregular morphology and semantics. Further analysis dividing the irregular verbs into two categories (weak irregular and strong) revealed that priming for strong verbs was reliably stronger than that for weak irregular and regular verbs, which were statistically indistinguishable from one another. We argue that, although we observe a regular-irregular dissociation, the nature of this dissociation is more consistent with single- than with dual-system models of inflectional morphology. (shrink)

The purpose of this article is to analyse how the background knowledge of travellers from the Old World have determined how they would experience American space. Such knowledge is more specifically directed in my study towards religion and politics, as my analysis intends to scrutinise how such realms made – and still make – subjects get to questionable conclusions since both Christianity and capitalism have had the normative tradition of disregarding the possibility of any meanings to deviate from their main (...) epistemes. My specific context, in this sense, concerns the travel book A Journey in Brazil and Maria Helena Machado’s compilation of William James’ diary – Brazil through the Eyes of William James – both written during the same trip to the Amazon. Main findings are: Louis Agassiz ambitious projects in America – more specifically the Amazon – prevented him from being as challenged by the journey as William James ends up being; there is enough literary evidence to assume that, in overall terms, his Christian bigotry made him immobile and unflappable when facing difference. In the last papers published by Alchourrón, he attacked non-monotonic logics, which he considered philosophically unsound for the representation of defeasible reasoning. Instead of a non-monotonic consequence relation, he proposed a formal representation of defeasibility based on an AGM-like revision of implicit assumptions connected to the premises. Given that this is a procedure to generate non-monotonic logics, it is not clear, from a mathematical standpoint, why he was so suspicious of such logics. In the present paper we try to answer (...) this question based on Alchourrón' s convictions about epistemology, particularly the epistemology of law. We also propose another revision operator on theories called refinement, which provides a faithful representation of the sort of epistemic change considered by Alchourrón as intrinsic to defeasibility. En sus últimos escritos publicados, Alchourrón desarrolló un ataque contra las lógicas no-monotónicas, que consideraba filosóficamente inadecuadas a la representación del razonamiento derrotable. En vez de una relación de consecuencia no-monotónica, él propuso una representación formal de la derrotabilidad basada en un modelo de revisión de las asunciones implícitas ligadas a las premisas. Dado que éste es un procedimiento para generar lógicas no-monotónicas, no está claro -en el nivel matemático- por qué él era tan desconfiado de tales lógicas. En el presente texto intentamos contestar a esta pregunta basados en las convicciones de Alchourrón sobre epistemología, particularmente la epistemología jurídica. También proponemos otro operador de revisión aplicado a las teorías, llamado refinamiento, que proporciona una representación fiel de la especie de cambio epistémico considerado por Alchourrón como intrínseco a la derrotabilidad. This article argues that rhetorical theory will never dominate a quasi-originary and ontolgising rhetoricity that nonetheless calls for it. This rhetoricity is not simply a game played ‘in the world’, to borrow Derrida's phrasing; it is—like writing, like metaphoricity, like the ‘yes-yes’ or (en)gage—one more name for ‘the game of the world’. To get some traction on this undeclinable yet unmasterable rhetoricity, we’ll examine what Derrida calls ‘a danger of rhetoricism’ in de Man's work, a tendency to overestimate the authority (...) of the linguistic, the verbal, the discursive. The goal is not so much to substantiate Derrida's suspicions about de Man's ‘rhetoricism’ as it is to get on the tail of a rhetorical force that is irreducible to it, an ineluctable affectability or responsivity that is bound up in the very structure of sur-vival. The well-established pattern of Executive expansionism and limited oversight of Executive action in times of terrorism is problematic from the civil libertarian point of view. How to limit such action has been the subject of much scholarship, a large amount of which focuses on perceptions of institutional competence rather than effectiveness. For the authors, the effective control of security-focused state action is to be judged by the extent to which it consists only of action that is necessary and proportionate and (...) thereby strikes an appropriate balance between security exigencies and individual rights. This article, written and structured in dialectic form, presents competing perspectives on effective oversight mechanisms: on the one hand, an extra-constitutionalism perspective, proposing a limited role for the Judiciary and emphasizing the need for legislative and democratic controls; and on the other, an argument for judicial muscularity. Animals navigate through three-dimensional environments, but we argue that the way they encode three-dimensional spatial information is shaped by how they use the vertical component of space. We agree with Jeffery et al. that the representation of three-dimensional space in vertebrates is probably bicoded (with separation of the plane of locomotion and its orthogonal axis), but we believe that their suggestion that the vertical axis is stored (that is, not containing distance or direction metrics usable for novel computations) is unlikely, (...) and as yet unsupported. We describe potential experimental protocols that could clarify these differences in opinion empirically. (shrink)

Utilitarianism has an apparent pedigree when it comes to animal welfare. It supports the view that animal welfare matters just as much as human welfare. And many utilitarians support and oppose various practices in line with more mainstream concern over animal welfare, such as that we should not kill animals for food or other uses, and that we ought not to torture animals for fun. This relationship has come under tension from many directions. The aim of this article is to (...) add further considerations in support of that tension. I suggest three ways in which utilitarianism comes significantly apart from mainstream concerns with animal welfare. First, utilitarianism opposes animal cruelty only when it offers an inefficient ratio of pleasure to pain; while this may be true of eating animal products, it is not obviously true of other abuses. Second, utilitarianism faces a familiar problem of the inefficacy of individual decisions; I consider a common response to this worry, and offer further concerns. Finally, the common utilitarian argument against animal cruelty ignores various pleasures that humans may get from the superior status that a structure supporting exploitation confers. (shrink)

Los _Sermones _de Cromacio de Aquilea nos ofrecen evidencia directa de su experiencia episcopal y literaria, que se divide entre la exégesis más destacada y el objetivo pastoral. La simplicidad estructural y lingüística, y la referencia a algunos autores contemporáneos, características de la tercera de estas composiciones homiléticas, nos ofrecen la oportunidad para analizar los propósitos más íntimos y prácticos de este texto. De hecho, la estrecha relación con su audiencia y el intento de guiarla por el justo camino cristiano (...) son los evidentes protagonistas en todo el discurrir del sermón. Sin embargo, al mismo tiempo se observa también la exégesis escritural de Cromacio y su profundización doctrinal: el Obispo trata de ofrecer un pequeño pero útil bagaje para el camino de quien lo escucha, en una poderosa valorización de la acción humana. La _vita activa _que se suma a la _lex naturae _inherente al alma humana constituye, de hecho, el tema más evidente de la homilía íntegra, que expone el de Aquilea sobre todo con el objetivo de fortalecer la unidad y la identidad de quienes escuchan cuando enfrentan presiones externas. La referencia escritural es fuerte y está presente en todo el sermón: el pasaje, seguramente leído justo antes de la exposición, se expone casi en su totalidad a los fieles, para fijarlo mejor en la memoria de aquellos que asisten a la lectura. Resumen Ésta es la primera traducción al español de las guías “Atención después de la investigación: un marco para los comités de ética de investigación del National Health Service (NHS) (borrador versión 8.0)”. El documento afirma que existe una fuerte obligación moral de garantizar que los participantes enfermos de un estudio clínico hagan una transición después del estudio hacia una atención de la salud apropiada. Con “atención de la salud apropiada” se hace referencia al acceso para los participantes a la (...) atención de la salud, proporcionada principalmente por el National Health Service (en adelante NHS), el sistema de salud del Reino Unido, y/o a la intervención en estudio, también llamada producto o tratamiento en investigación. Las guías “Atención después de la investigación” están dirigidas principalmente a los miembros de los 79 comités de ética de investigación del NHS y a quienes presentan sus estudios de investigación ante estos comités. Se trata de un documento borrador muy avanzado, trabajado en numerosas reuniones, durante más de 3 años, que ha sido discutido por participantes de estudios y miembros de la comunidad, miembros y presidentes de comités de ética de investigación del Reino Unido, especialistas internacionales en ética de la investigación, representantes de la industria y otras partes interesadas. La redacción de las guías es producto de la colaboración de Neema Sofaer y Penney Lewis, ambas investigadoras del King’s College London, en el Centre of Medical Law and Ethics del Dickson Poon School of Law, y Hugh Davies, Asesor en Ética de la Investigación de la Health Research Authority (HRA) del NHS. The guides "Care after research" are mainly directed to members of the 79 NHS committees of research ethics (RECs) and to those who submit their research to these committees. This is a very advanced draft document, worked in several meetings, for more than three years, that has been discussed with study participants and community members, members and chairs of RECs in the UK, international specialists in research ethics, industry representatives and other stakeholders. The drafting of the guidelines is the result of the collaboration of Neema Sofaer and Penney Lewis, both researchers at King's College London, at the Centre of Medical Law and Ethics of Dickson Poon School of Law, and Hugh Davies, Research Ethics Advisor of the Health Research Authority (HRA) of the NHS. Em suas reflexões sobre a filosofia do direito, Alysson Leandro Mascaro destacou que atualmente G.W.F. Hegel é uma estação fundamental para qualquer estudioso dessa ciência. De fato, o autor alemão mostra-se de fundamental importância por pensarmos a sociedade civil burguesa e o Estado como aspectos inseparáveis para a necessária determinação do direito na era moderna (e contemporânea). Ao contrário da proposta jusnaturalista, Hegel coloca a questão do direito no interior da querela sobre o Estado moderno, esvaziando de sentido a ode (...) ao individualismo, de fundo romântico. Assim, a máquina pública surge como expressão concreta de um momento histórico muito particular, leia-se, como fruto da era das profundas revoluções sociais na Europa. Destarte, nossa hipótese é que a filosofia do direito hegeliana não se limita à uma consciência tardia, que sempre se apresenta como post festum, mas, sim, desenvolve-se como uma reflexão capaz de antever aspectos importantes de toda uma formação histórica em emergência, através dos seus primeiros sinais. Essa perspectiva nos permite argumentar que esse autor buscou se apresentar como síntese dialética da realidade e dos conceitos que conheceu, fitando não se dobrar às complexidades e/ou à vulgata do momento que tinha sob os olhos. The current work investigated whether differences in phonological overlap between the past- and present-tense forms of regular and irregular verbs can account for the graded neurophysiological effects of verb regularity observed in past-tense priming designs. Event-related potentials were recorded from 16 healthy participants who performed a lexical-decision task in which past-tense primes immediately preceded present-tense targets. To minimize intra-modal phonological priming effects, cross-modal presentation between auditory primes and visual targets was employed, and results were compared to a companion intra-modal auditory (...) study (Justus, T., Larsen, J., de Mornay Davies, P., Swick, D. (2008). Interpreting dissociations between regular and irregular past-tense morphology: evidence from event-related potentials. Cognitive, Affective, Behavioral Neuroscience, 8, 178–194.). For both regular and irregular verbs, faster response times and reduced N400 components were observed for present-tense forms when primed by the corresponding past-tense forms. Although behavioral facilitation was observed with a pseudopast phonological control condition, neither this condition nor an orthographic-phonological control produced significant N400 priming effects.
